Introduction
Welcome to Halaluna (“Platform,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of the Halaluna marketplace, including all services, features, and transactions made available through the Platform.
By accessing or using Halaluna, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Nature of the Platform (Venue Only)
Halaluna operates as a technology platform and online venue that connects buyers and independent third-party sellers (“Vendors”).
Halaluna is not a party to any transaction between Buyers and Vendors.
Accordingly:

Halaluna does not own, manufacture, store, or sell any listed products

Halaluna does not handle shipping, delivery, or fulfillment

All transactions are directly between Buyers and Vendors
By using the Platform, you acknowledge that Halaluna only provides a venue for listing and purchasing goods.
Eligibility
Users must be at least 18 years old (or the age of majority in their jurisdiction) and capable of entering into legally binding agreements.
Users agree to provide accurate, current, and complete information when registering and using the Platform.
Vendor Responsibilities and Halal Compliance
Vendors are solely responsible for:

Ensuring all product listings are accurate, lawful, and not misleading

Providing valid halal certification or supporting documentation where applicable

Ensuring that all products comply with halal requirements as represented
Halaluna may perform basic screening of Vendors but does not independently verify, audit, or laboratory-test products.
Halal Integrity Disclaimer:
Halaluna does not guarantee or warrant that any product listed is halal-certified or compliant. Responsibility for halal compliance rests entirely with the Vendor.
Payments and Third-Party Payment Processors
Payments are processed through third-party payment providers such as Stripe, PayPal, or similar services.
By using the Platform, you also agree to be bound by the terms and policies of these third-party payment processors.
Vendors authorize Halaluna to:

Process payments on their behalf through the designated payment processor

Deduct applicable commission fees from each completed transaction

Transfer remaining funds to the Vendor according to payout schedules
Halaluna does not store full payment card details.
Commission and Fees
Halaluna charges Vendors a commission fee per successful transaction.

Commission is automatically deducted before payout

Rates may be updated with prior notice to Vendors
Transactions, Acceptance, Cancellations, and Refunds

Vendors must accept or reject orders within a specified timeframe of [X days]

If no action is taken within the timeframe, the order may be automatically canceled and refunded to the Buyer

Refunds are subject to Platform rules and payment processor policies
Halaluna is not responsible for disputes arising from non-fulfillment by Vendors.
Taxes
Vendors are solely responsible for determining, collecting, reporting, and remitting all applicable taxes (including VAT, GST, sales taxes, or other applicable charges) in their respective jurisdictions.
Halaluna does not act as a tax agent or assume any tax obligations on behalf of Vendors.
User-Generated Content (Reviews and Feedback)
Users may post reviews, ratings, and other content (“User Content”) on the Platform.
Users agree not to post content that is:

False, misleading, or defamatory

Offensive, abusive, or discriminatory

Illegal or violates third-party rights
Halaluna reserves the right to remove or moderate User Content and suspend accounts that violate these rules.
Halal Verification, Audit Rights, and Enforcement
To maintain trust in the Halaluna platform:

Halaluna reserves the right to request halal certification or supporting documentation from Vendors at any time

Vendors found intentionally misrepresenting non-halal products as halal may be permanently banned without notice

Halaluna may remove or suspend any listing suspected of violating halal standards
Prohibited Activities
Users agree not to:

Engage in fraudulent, deceptive, or illegal activity

Misrepresent products or business identity

Interfere with Platform operations or security systems
-
Circumvent payment, commission, or Platform processes
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
HALALUNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE USE OF THE PLATFORM.
HALALUNA’S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL COMMISSION FEES EARNED BY THE PLATFORM FROM THE TRANSACTION GIVING RISE TO THE CLAIM.
Disclaimer of Warranties
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.
Halaluna makes no warranties or representations, including but not limited to:

Continuous or error-free operation of the Platform

Accuracy of product listings or halal claims made by Vendors

Fulfillment of transactions by Vendors
Suspension and Termination
Halaluna reserves the right to suspend or terminate any account at its sole discretion for:

Violation of these Terms

Fraudulent or abusive behavior

Misrepresentation of products or halal status
Changes to Terms
Halaluna may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
